This document represents an official offer from the Internet site dallure.travel, IP Karmanov Dmitry Aleksandrovich, hereinafter referred to as the “Seller,” to conclude a contract for the purchase and sale of an Internet product remotely and the provision of consulting services on the conditions set out below.
1.DEFINITION OF TERMS
1.1. Public offer (hereinafter referred to as the “Offer”) – a public offer of the Seller, addressed to an indefinite number of persons, to conclude a purchase and sale agreement with the Seller for an Internet product with provision of access to information materials and content of the Site (hereinafter referred to as the “Works”) remotely on the terms and conditions consulting services contained in this Offer (hereinafter referred to as the “Agreement”).
1.2. Acceptance of the Offer — full and unconditional acceptance of the Offer by the Buyer performing the actions specified in this Offer, creating an Agreement between the Buyer and the Seller.
1.3. Website is an Internet resource intended to provide the Buyer with access to the content of the Site and available on the Internet at the address: dallure.travel (hereinafter referred to as the “Site”).
1.4. Order – items specified by the Buyer from the range of Products and the list of services offered for sale when filling out an application for the purchase of Products on the Site.
1.5. Works – works within the meaning of Article 1259 of the Civil Code of the Russian Federation, posted on the Site, the rights to which belong to the Contractor (hereinafter referred to as “Works” and (or) “content”, including routes, guides and other information.
2. GENERAL PROVISIONS
2.1. The agreement concluded through Acceptance of the Offer is regulated by the norms of civil law on the agreement of adhesion (Article 428 of the Civil Code of the Russian Federation) – since its terms are determined by the Seller in this Offer and can be accepted by any person only by joining the proposed Agreement as a whole without any exceptions and restrictions.
2.2. The public offer includes this document with all appendices, amendments and additions to it, posted on the Seller’s Website.
2.3. The Buyer who accepted the Offer confirms and acknowledges that he has reached the age to conclude the relevant Agreement, and also understands that he independently bears all responsibility in the event of harm and (or) damage to third parties resulting from the Buyer’s use of the Products and services.
2.4. The Buyer’s order for a Product or service posted on the Site means that the Buyer agrees with all the terms of this Offer.
2.5. The Seller has the right, at its discretion, to make changes to the Offer at any time without notifying the Buyer, as well as to withdraw it in the manner provided for in this Agreement.
2.6. If the terms of the Offer are changed, the changes come into force from the moment the changed terms of the Offer are published on the Site, unless a different period is specified by the Seller in the relevant notice of changes.
2.7. This Offer comes into force from the moment it is posted on the Site. The validity period of the Offer is unlimited, unless otherwise indicated on the Site.
2.8. The Seller provides the Buyer with complete and reliable information about the Products and services in the relevant sections of the Site.
2.9. The product is offered for use by the Buyer on an “As is” basis. No warranties other than those expressly stated in this Offer are attached or provided.
2.10. The Buyer undertakes not to upload or otherwise make available to the public the Works and other results of intellectual activity of the Seller or other copyright holders, in the absence of the express written consent of the copyright holder/Seller, as well as to indicate anywhere in any way (including by posting a link) to the location of such materials.
2.11. All actions performed using the Buyer’s data are the actions of the Buyer himself, which is indisputable evidence of the Buyer’s will.
3.PRICE OF PRODUCTS / SERVICES
3.1. The price for each Product and service is indicated on the Site.
3.2. The Seller has the right to unilaterally change the price of any Product or service.
3.3. The Buyer has the right to confirm or cancel the Order for a Product or service if the price is changed by the Seller after placing the Order.
3.4. The Seller may not change the price for the Product or service paid by the Buyer.
3.5. The Buyer’s obligations to pay for the Product or service are considered fulfilled from the moment funds are received into the Seller’s bank account.
3.6. Payments between the Seller and the Buyer for the Product or service are made in the ways specified on the Site when placing an Order.
4.PLACE YOUR ORDER
4.1. The Order of the Product is carried out by the Buyer through the service of the Website dallure.travel.
4.2. When registering on the Site, the Buyer undertakes to provide the following registration information:
4.2.1. last name, first name, patronymic of the Buyer;
4.2.2. email address;
4.2.3. contact phone number.
4.3. The name and price of the Product selected by the Buyer are indicated in the Buyer’s cart on the Site,
4.4. The Buyer may pay for access to the content of the Site according to the prices indicated on the Site.
4.5. The Seller is not responsible for the content and accuracy of the information provided by the Buyer when placing an Order (including all data required for registration).
4.6. The Buyer is responsible for the accuracy of the information provided when placing an Order.
4.7. The remote purchase and sale agreement between the Seller and the Buyer is considered concluded from the moment the Seller receives a message about the Buyer’s intention to purchase the Work.
4.8. Information about placing an Order and payments made for the Product or service is sent to the Buyer by email specified when registering on the Site.
5.ACCESS TO THE WORK FOR THE BUYER
5.1. Access to the Work after payment is carried out by entering a special password on a closed page of the Site, which is sent to the Buyer’s email specified during registration.
